Caregiver Engagement & Liability Disclaimer Policy

Important Notice

Please read these terms carefully before engaging any caregiver through our platform. By proceeding, you acknowledge that you understand and accept all terms outlined below.

Independent Engagement

Caregivers listed on our platform are independent individuals.

Clients engage caregivers at their own discretion and entirely at their own risk.

We do not employ, supervise, manage, or control caregivers.

We do not guarantee caregiver suitability, conduct, qualifications, or performance.

No Vetting or Background Checks

Caregivers are not vetted by us. This includes:

• Criminal background checks

• Identity verification

• Reference checks

• Qualification or certification verification

• Immigration or work authorization verification

Clients are solely responsible for conducting any background checks, interviews, reference checks, and verification they deem necessary before hiring a caregiver.

Assumption of Risk

By engaging a caregiver, the client acknowledges and accepts all risks associated with inviting a third party into their home or place of care, including but not limited to:

• Theft or loss of property

• Personal injury

• Injury to family members, dependents, or visitors

• Damage to property

• Negligence, misconduct, or inappropriate behaviour

Liability & Indemnity

We shall not be held liable for any loss, damage, injury, claim, expense, or legal action arising directly or indirectly from the engagement of a caregiver.

The client agrees that all liability is borne solely by the individual who hires the caregiver, including:

• Theft or fraud

• Personal injury or death

• Property damage

• Legal claims, disputes, or compensation demands

The client agrees to indemnify and hold harmless the platform, agency, and its representatives from any claims arising from the caregiver's actions or omissions.

No Insurance Coverage

We do not provide insurance coverage of any kind for caregivers or clients, including:

• Liability insurance

• Theft or property damage insurance

• Injury or accident insurance

Clients are encouraged to consult their own insurer regarding coverage before engaging a caregiver.

Employment & Legal Compliance

The caregiver is not an employee of our organization.

Any employment relationship, tax obligations, UIF contributions, minimum wage compliance, or statutory requirements are solely the responsibility of the client.

Safety Recommendations (Client Responsibility)

Clients are strongly advised to take the following precautions:

Conduct interviews and reference checks
Verify identification documents
Avoid sharing financial details or valuables
Secure personal belongings
Clearly define duties, hours, and expectations in writing
Consider trial periods and supervision
Ensure a safe working environment
No Guarantees

We make no guarantees regarding caregiver reliability, honesty, competence, or continuity of service.

Acceptance of Policy

By proceeding to engage a caregiver, the client confirms that they have read, understood, and accepted this policy in full, and acknowledge that they are engaging caregivers entirely at their own risk.
